I. GENERAL PROVISIONS

1. These regulations (hereinafter referred to as the "Regulations") were issued on the basis of the provisions of the Act of 20 March 2009 on the safety of mass events (Journal of Laws 2019, item 2171, consolidated text), the Act of 23 April 1964, the Civil Code (Journal of Laws 2020, item 1740, consolidated text, as amended) and other generally applicable legal provisions.

2. The Regulations are issued by the Nowa Muzyka Katowice Foundation with its registered office in Katowice, ul. Wojewódzka 26a/5, entered into the register of entrepreneurs of the District Court Katowice-Wschód in Katowice, 8th Commercial Division under the KRS number 0000976370 (hereinafter referred to as the "Organizer"), the Organizer of the event called: Tauron Nowa Muzyka Katowice 2026, which will take place in Katowice on 4.06-7.06.2026 (hereinafter referred to as the "Event").

3. These Regulations apply to all persons who will be in the area where the Event is taking place during the Event. Each person staying in the area during the Event is obligated to comply with the provisions of these Regulations.
At the same time, each person deciding to participate in the Event accepts all the provisions and conditions of the Regulations.
Persons participating in the Event are obliged to behave in a way that does not endanger the safety of other people, and in particular to comply with the provisions of these Regulations.

4. The purpose of these Regulations is to ensure safety by defining the rules of conduct of persons present at the Event and their use of the premises where the Event is held, as well as the facilities and other property located therein, and also to regulate the rights and obligations of Participants in connection with the purchase of a Ticket for the Event (conditions of participation).

II. DEFINITIONS

5. The terms used in these Regulations mean the following:

  • “Ticket” means an individual consent to enter the Event, which is exchanged for an Identifier (wristband) upon first entry to the Event Venue;
  • "Identifier" means an identifier issued by the Organizer upon entry to the Event Venue upon return of the ticket; the Identifier will be in the form of a wristband permanently attached to the wrist, the design of the wristband is determined by the Organizer; the Identifier may only be used by one person; damaging or tearing the Identifier will result in its loss of validity; it is prohibited to share the Identifier with other persons;
  • “Zone” means a specific zone within the Event Venue, access to which is dependent on the purchase of an appropriate type of Ticket and the issuance of an appropriate Identifier or possession of appropriate authorizations;
  • "Security Services" means individuals appointed by the Organizer, including security agency employees who hold identification badges, to ensure the safety of individuals participating in the Event, including verifying the Participants' access to the Event Venue. Security Service members possess ID badges placed in a visible place, containing: the name of the issuer, identification number and photograph, validity period, stamp, and signature of the issuer;
  • "Event Venue" means the designated location or locations where the Event and accompanying events are held. The Event Venue is made publicly available prior to the Event, including on the Event website, the Event mobile app, printed maps available at the Event Venue, etc.;
  • "Participant" means a person participating in the Event based on an ID issued upon return of a Ticket. A minor under 16 years of age may also participate, under the supervision of an adult and under the sole responsibility of the adult in whose care they remain after purchasing Tickets for both the minor and the adult. Children under 10 years of age are exempt from the requirement to possess a Ticket, provided they present a document confirming the child's age.

III. TICKET SALES

6. Tickets are sold only at authorized points of sale and by authorized distributors. Tickets may only be sold at the price indicated on the Ticket. A list of authorized points of sale and distributors is available on the Event website.
The Ticket sales schedule, Ticket types and prices are made public before the Event on the website dedicated to the Event and on the websites of Ticket distributors.
Ticket Distributors are entitled to conduct sales based on their own regulations.
The Organizer informs that each Ticket is marked with a unique barcode or other type of unique marking and that each Ticket entitles to a one-time entry to the Event Venue combined with the exchange of the Ticket for an Identifier.
The Organizer warns that if a Ticket is made available in any form to a third party, it may be used by that person or another person to enter the Event Venue, which will result in the original purchaser of the Ticket being unable to use it. The Ticket Purchaser should therefore ensure that the Ticket is kept confidential and not disclosed to third parties.
The Organizer warns that purchasing Tickets from third parties carries the risk of purchasing a counterfeit ticket, which will result in refusal to exchange the Ticket for an Identifier and, consequently, refusal of entry to the Event.
The Organizer hereby informs that, pursuant to Article 133 § 1 of the Code of Petty Offenses, it is prohibited to purchase tickets to artistic, entertainment, or sporting events for resale at a profit, or to sell such tickets at a profit. Attempting, inciting, or aiding and abetting such acts are punishable.
Any public offering of the transfer of ownership of Tickets, including as prizes in competitions, lotteries, bonus sales or any other promotions, even if free of charge, is prohibited, unless the Organizer gives its consent.
Ticket returns and refunds are only possible in the cases expressly set forth in these Regulations, including the cancellation of the Event, a change of venue or date, or restrictions imposed on the Organizer by public authorities. In such cases, the Organizer will provide information on the possibility and terms of Ticket returns.
Failure to use the Ticket does not entitle you to claim a refund.

7. Sponsors, media patrons, and selected media representatives (radio, television, press), upon obtaining the Organizer's consent, are authorized to organize competitions in which the prize will be personalized Tickets to the Event. Tickets won in the competition may only be used by the winner, cannot be transferred to a third party, and must be exchanged for an ID upon presentation of the Ticket and proof of identity. Prize tickets cannot be exchanged for cash or other equivalents. The rules and procedures for competitions are governed by the separate regulations of the entities organizing them.

8. Only original Tickets purchased in accordance with these Regulations and the regulations of points of sale and authorized distributors may be exchanged for IDs. Tickets purchased in violation of these Regulations may be invalidated by the Organizer (or its representative), without the right to a refund.

9. If a disabled person (with a confirmed disability group) wishes to participate in the Event, they are required to purchase a Ticket under normal terms. If a disabled person (with a confirmed disability group) uses a wheelchair, crutches, a walker, has a visual or hearing impairment due to their physical disability, or requires constant care due to their intellectual disability, their guardian is entitled to purchase a Ticket with a 50% price reduction.
A disabled person participating in the Event with a guardian is required to have a certificate confirming their assigned disability group during the Event. The Organizer reserves the right to verify possession of the certificate referred to in the preceding sentence, in particular upon entry to the Event of a disabled person with their guardian who has taken advantage of the opportunity to purchase a Ticket with a discount.

IV. ADMISSION TO THE EVENT

10. Subject to the provisions of Chapter VIII of the Regulations, the right to enter the Event Venue is granted to a person with an identity card and a valid Ticket, which will be exchanged for an Identifier upon first entry to the Event Venue.
Only the Participant with the Identifier permanently attached to his or her wrist is entitled to re-entry to the Event Venue.
If the Participant is a minor under 16 years of age, he/she may participate in the Event only under the supervision of an adult who, upon first entering the Event, signs a declaration of responsibility for the minor at the information point, using the form provided by the Organizer.
In order to participate in the Event without adult supervision, minors aged 16-18 are required to submit a declaration of consent to their participation in the Event, signed by their legal guardian, to the information point.

11. Regardless of the conditions referred to in point 10 above, entry to the Event Venue is not granted to a person:

  • against whom a judgment was issued:

    prohibiting entry to a mass event,
    obliging to refrain from staying in places where mass events are held, issued by a court against a convicted person in connection with the conditional suspension of the execution of a prison sentence or against a minor under Article 6 point 2 of the Act of 26 October 1982 on proceedings in juvenile cases;

  • against whom a club ban or foreign ban has been imposed in accordance with the Act on the Safety of Mass Events;
  • in relation to whom there is a reasonable suspicion that at the place and during the mass event he or she may pose a threat to the safety of the mass event; is visibly under the influence of alcohol, narcotics, psychotropic substances or other similar substances;
  • who refuses to submit to the enforcement activities specified in Chapter V of the Regulations;
  • possessing weapons or other dangerous items, explosives, pyrotechnic products, fire-hazardous materials, alcoholic beverages, narcotics or psychotropic substances; the assessment of items and their classification as dangerous is the responsibility of the law enforcement services and information services;
  • behaving aggressively, provocatively or in any other way posing a threat to public safety or order.

12. Regardless of the circumstances referred to in point 11, the Organizer may refuse entry to the Event and stay on the Event Venue to persons:

  • not having an ID;
  • wearing shoes with metal tips;
  • whose external appearance makes it impossible to identify;
  • having plastic or glass containers, cans, bottles, etc. – does not apply to Participants entering the Event Venue with a child, if the containers they bring are used and necessary to serve the child a drink or meal; not having an identity document;
  • behaving in an inappropriate manner (suggesting being under the influence of alcohol, psychotropic or intoxicating substances, aggressive, uncomfortable for other Participants).

13. Entry to the individual designated Zones within the Event Venue is granted to individuals with the appropriate ID. The Organizer divides the Event into zones: concert stages, technical and social facilities, audience area, food and beverage area, children's area, main entrance complex, sanitary facilities, permanent security guard stations, and camping.

V. ORGANIZATIONAL AND ORDER RULES APPLICABLE AT THE EVENT AREA

14. The Organizer ensures the safety of persons present at the Event and order during the Event by fulfilling the obligations referred to in Article 6 of the Act on the Safety of Mass Events, in particular:

  • the participation of the Security Services and Information Services with distinctive clothing elements; the appointment of a security manager to manage the Security Services and organize their work;
  • providing medical assistance and hygiene and sanitary facilities; providing medical assistance;
  • designation of evacuation routes and roads enabling access for emergency service and police vehicles.

15. Event participants and all other persons present at the Event Venue are obliged to follow the instructions of the Security Service, including the Safety Manager.

16. Participants of the Event and all other persons present at the Event Venue are obliged to behave in a way that does not endanger the safety of other persons present at the Event, and in particular to comply with the provisions of the Regulations.
It is prohibited to destroy signs and information boards, advertising media, devices and equipment located at the Event Venue, etc. Participants are obliged to use sanitary facilities only for their intended purpose.

17. Participants and all persons present at the Event Venue are required to wear a valid ID badge at all times during the Event. Failure to wear a badge, a torn or damaged badge, or a badge not fastened to the wrist constitutes grounds for removal from the Event Venue. In the event of a torn or damaged badge, the Participant is required to immediately report the damaged badge to the Information Services at the Event gate (entrance), where the damaged badge will be replaced with a new one fastened to the wrist. Only badges damaged within the Event Venue will be eligible for replacement.

18. It is prohibited to bring or possess professional cameras, video cameras, or other audio or audio-video recording equipment during the Event. Amateur digital cameras and traditional amateur compact cameras may be brought into the Event Venue. It is prohibited to bring photographic equipment that could be used professionally, such as 35mm SLRs, digital SLRs, medium- and large-format cameras, etc.

19. It is prohibited to bring dogs and other animals to the Event Venue, with the exception of blind or disabled persons who require the assistance of a guide dog.

20. It is prohibited to conduct any commercial or profit-making activities at the Event Venue without the consent of the Organizer.

21. The Organizer, to the extent specified in the Mass Event Safety Act and implementing regulations, is authorized to record the course of the Event, in particular the behavior of individuals, using image and sound recording devices. Any materials collected during the recording of the Event that may constitute evidence allowing the initiation of criminal proceedings or misdemeanor proceedings, or evidence relevant to ongoing such proceedings, will be immediately forwarded by the Organizer to the district prosecutor with jurisdiction over the Event Venue or to the Police. Materials collected during the recording of the Event that do not contain evidence allowing the initiation of criminal proceedings or misdemeanor proceedings, or evidence relevant to ongoing such proceedings, will be stored after the conclusion of the Event for a period of at least 30 days, but no longer than 90 days, and will then be destroyed in the presence of a commission.

22. The Security Services, displaying an ID badge placed in a visible place, are entitled, in accordance with the provisions of the Act on the Safety of Mass Events, to:

  • checking the eligibility to attend the Event,
  • checking the identity of persons in order to establish their identity,
  • inspecting the contents of people’s luggage and clothing if there is a suspicion that they are bringing or possessing items referred to in Chapters IV and V of the Regulations,
  • determining the rights of persons to be present at the Event, and in the event of a lack of such rights – requesting them to leave the Event,
  • issuing orderly instructions to persons disturbing public order or behaving contrary to the Regulations, and in the event of failure to comply with these instructions – requesting them to leave the Event,
  • use of physical force in the form of incapacitating holds and similar defense techniques in the event of a threat to property entrusted to protection or repelling an attack on a member of the Security Services or another person, under the terms specified in Article 38 of the Act of 22 August 1997 on the protection of persons and property,
  • apprehend, for immediate handover to the Police, persons posing a direct threat to human life or health, as well as protected property.

23. The Security Service is obliged to remove from the Event Venue persons whose behaviour disturbs public order or is contrary to the Regulations.

24. Members of the Security Service, depending on potential risk and needs, may be equipped with, among others:

  • handheld metal detectors,
  • templates of tickets, badges and invitations,
  • other necessary and legally permitted personal protective equipment.

25. A member of the Security Service shall determine the right of a person to be present at the Event by:

  • checking whether the person has a valid Ticket and, after exchanging it, whether they have an undamaged ID badge on their wrist,
  • comparison of the presented document with the specimen.

26. If the contents of the luggage or clothing being inspected contain items that are prohibited from being brought into or possessed at the Event, a member of the Security Service shall refuse entry to the Event Venue to the person found in possession of these items or shall order that person to leave the Event Venue.

27. If weapons or other dangerous items, explosives, pyrotechnics, fire hazards, or prohibited narcotics and psychotropic substances are found in the contents of the luggage or clothing being inspected, a member of the Security Service shall apprehend the person whose luggage or clothing was inspected and, after collecting the items, shall prepare a report of this action and then hand the person over to the Police along with the items being collected.

28. Persons who were refused entry to or stay at the Event or who were removed from the Event Venue in accordance with the provisions of the Regulations due to their violation or due to a violation of generally applicable legal provisions shall not be entitled to a refund of the Ticket price.

29. The Organizer undertakes to ensure fire safety, among others, by:

  • providing information on the location of fire-fighting equipment and the rules of conduct in the event of a fire by service staff, organizers and security services,
  • ensuring training of the Security Services in the following areas: evacuation rules, methods of alerting the fire brigade, rules of using hand-held fire-fighting equipment and providing first aid.

30. During the Event, the Organizer and Participants, as well as other persons staying on the premises, are obliged to comply with the provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism.

31. The accepted form of payment at the Event Venue, particularly in the catering area, is gift vouchers and/or payment by credit card. Cash for gift vouchers can be exchanged at designated points throughout the Event Venue.

VI. RIGHTS AND OBLIGATIONS OF EVENT PARTICIPANTS

32. The Organizer reserves the right to establish and amend the Event program for justified reasons, and also reserves the right to alter the program artistically and temporally without prior consultation, compensation, or damages to Participants. Changes to the Event program do not entitle the holder to return Tickets or claim a refund.

33. Due to the large number of Participants, the need to exchange Tickets for IDs and the necessary control and security measures applied at the entrance to the Event, Participants are kindly requested to arrive at the Event venue well in advance.

34. The Organizer hereby informs that for concerts and events held in closed halls with limited seating, possession of a valid Ticket/ID does not guarantee admission to such concert or event. For the safety of attendees, admission to each hall will be limited, and entry will be on a first-come, first-served basis. Advance reservations are not possible.

35. The Organizer hereby informs that any Participant or other person at the Event Venue will be exposed to constant loud noises that may cause hearing damage. Strobe lights will be used during the Event.

36. The Organizer reserves the right to record the Event for the purposes of documentation, promotion, or advertising of the Event and its subsequent editions in future years, the Organizer, and sponsors. The image of persons present at the Event Venue may be recorded and subsequently disseminated for documentation, reporting, advertising, and promotional purposes. Therefore, the Organizer may process Participants' personal data – in the form of their image – pursuant to Article 6, Section 1, Letter f) of the GDPR, in connection with the Organizer's legitimate interest described above. This data will be stored until the User effectively objects – pursuant to the provisions of the GDPR.

37. There will be a Children's Zone at the Event Venue, available for children aged 4 to 12.

VII. COMPLAINTS

38. All complaints may be submitted in writing to the following correspondence address of the Organizer:

The Organizer will consider complaints within 21 days from the date of their delivery to the Organizer by registered mail.

VIII. PRIVACY POLICY

Participants' personal data will be processed for the purpose of performing the contract to which the Participant is a party in connection with participation in the Festival regarding ticketed events – pursuant to Art. 6 sec. 1 letter b) of the GDPR. In the case of Participants who received Festival tickets as prizes in competitions organized by the Controller or third parties, their personal data will be processed for the purpose of verifying eligibility for the prize – pursuant to Art. 6 sec. 1 letter f) of the GDPR, in connection with the Controller's legitimate interest described above. In the case of individuals who receive accreditation, data will be processed on the basis of Art. 6 sec. 1 letter b) of the GDPR in connection with participation in the Festival within the scope of the accreditation received.
Due to the current epidemic situation, the Administrator reserves the right to process Participants' personal data, such as name, telephone number, and email address, pursuant to Article 6(1)(d) of the GDPR, in order to protect the vital interests of the Participant and other Participants, i.e., to enable an epidemiological investigation and inform the participant of the epidemic threat. This data may also be transferred to the relevant sanitary and epidemiological services to fulfill their obligations under the law related to combating the epidemic.
The recipients of the collected personal data will only be entities authorized to receive such data under applicable law. In particular, pursuant to Article 8a of the Act of 14 March 1985 on the State Sanitary Inspectorate, participant's personal data may be made available to the Chief Sanitary Inspector and law enforcement agencies.
Personal data will be stored for a period of 14 days from collection. After this time, the data may be stored for the purposes of the Controller's legitimate interest, for the purpose of handling claims related to the organization of the Festival and the performance of contracts to which the Participant is a party in connection with participation in the Festival – pursuant to Art. 6, Section 1, Letter f) of the GDPR – until such claims expire or become time-barred.
Participants have the right to access their data and to rectify, delete or limit its processing, as well as the right to object and demand the cessation of data processing and transfer, in accordance with the principles specified by law.
Participants have the right to lodge a complaint with the supervisory authority, the President of the Office for Personal Data Protection, if they suspect that their personal data are being processed in violation of the provisions of generally applicable law.
Providing personal data is voluntary. Failure to provide data will result in the inability to participate in events organized by the administrator. Participants' personal data will not be transferred to a third country or international organization.
Participants' personal data will not be the basis for automated decision-making or profiling as referred to in Article 22 of the GDPR.

VIII. FINAL PROVISIONS

41. All rights to the Event name and logo are reserved by the Organizer. Official Event programs and merchandise will be sold only at the Event Venue or at points of sale authorized by the Organizer.

42. The status of sponsor of the Event is granted exclusively by the Organizer.

43. These Regulations are available:

  • on the Event's website – www.festiwalnowamuzyka.pl,
  • at Ticket sales points,
  • at information points in the Event Venue,
  • at the ticket offices.

44. Correspondence to the Organizer should be sent in writing, by registered mail, to the address indicated in point 2.

45. Security Services may issue their own safety and fire safety instructions in accordance with applicable regulations that apply to Event participants. In matters not covered by these Regulations, generally applicable laws shall apply.
The Organizer reserves the right to change the provisions of the Regulations, which will be announced on the website dedicated to the Event.
The Regulations come into force on May 1, 2026
