I. GENERAL PROVISIONS
1. These Regulations (hereinafter: "Regulations") have been issued on the basis of the provisions of the Act of March 20, 2009, on the safety of mass events (Journal of Laws 2023.616 as amended), the Act of April 23, 1964 - Civil Code (Journal of Laws 2025.1071 as amended) and other generally applicable legal provisions.
2. The Regulations are issued by the Nowa Muzyka Katowice Foundation with its registered office in Katowice, ul. Wojewódzka 26a/5, entered into the register of associations, other social and professional organizations, foundations, and independent public healthcare facilities, as well as into the register of entrepreneurs of the National Court Register maintained by the District Court Katowice – East in Katowice, VIII Economic Department - KRS under KRS number: 0000976370 (hereinafter referred to as the "Organizer"), the organizer of the event named: Tauron Nowa Muzyka Katowice 2026, which will take place in Katowice on June 4-7, 2026 (hereinafter referred to as the "Event").
3. The Regulations apply to all persons who will be present in the area where the Event takes place during the Event. Every person present in this area during the Event is obliged to comply with the provisions of these Regulations.
At the same time, every person deciding to participate in the Event accepts all the provisions and conditions of the Regulations. Persons participating in the Event are obliged to behave in a manner that does not endanger the safety of other people, and in particular to comply with the provisions of these Regulations and the regulations of the facilities where the Event takes place (made available to Participants within these facilities).
4. The purpose of these Regulations is to ensure the safety of the Event and its participants by defining the rules of conduct for persons present at the Event and their use of the area and facilities where the Event is held, as well as the equipment and other property located therein, and also to regulate the rights and obligations of Participants in connection with the purchase of a Ticket for the Event (conditions of participation).
II. DEFINITIONS
5. The terms used in these Regulations mean the following:
"Ticket" means an individual entry permit for the Event, which upon the first entry to the Event Area is exchanged for an Identifier (wristband); "Identifier" means an identifier issued by the Organizer upon entry to the Event Area in exchange for a Ticket (or on the basis of another document issued by the Organizer), which confirms the right of a given person to be present in the Event Area; the Identifier will be in the form of a wristband permanently placed on the wrist, the design of the wristband is determined by the Organizer; only one person can use one Identifier; damage or tearing of the Identifier results in its invalidity; transferring the Identifier to other people is forbidden; "Zone" means a specific zone in the Event Area, access to which depends on the purchase of the appropriate type of Ticket and the issuance of a corresponding Identifier or possession of other appropriate authorizations granted by the Organizer; "Security Services" means persons appointed by the Organizer, including employees of security agencies, holding an identifier, to ensure the safety of persons participating in the Event, including checking the Participants' right to enter the Event Area. Members of the Security Services have identifiers placed in a visible place containing: the issuer's name, identification number and photograph, period of validity, stamp and signature of the issuer; "Event Area" means a designated place or places where the Event and accompanying events are held. The Event Area is announced publicly before the Event, e.g., on the website dedicated to the Event, within the mobile application dedicated to the Event, printed maps available in the Event Area, etc.; "Participant" means a person participating in the Event on the basis of an Identifier issued in exchange for a Ticket. A minor person under 16 years of age may also be a Participant, under the care of an adult and at the sole responsibility of the adult in whose care they remain, after purchasing Tickets for both the minor and the adult. Children under 10 years of age are exempt from the obligation to possess a Ticket, provided they present a document confirming the child's age and are under the care of an adult with a Ticket and at their responsibility.
III. TICKET SALES
6. Tickets are sold exclusively: 1) by the Organizer through its website ([•]); 2) at authorized points of sale, and 3) by authorized distributors. Tickets may only be sold at the price indicated on the Ticket. A list of authorized points of sale and distributors is available on the Event website.
The Ticket sales schedule, types of Tickets, and prices are publicly announced before the Event on the website dedicated to the Event and on the websites of Ticket distributors. Ticket distributors are authorized to conduct sales based on their own regulations. The Organizer informs that each Ticket is marked with a unique barcode or other unique identifier, and that each Ticket entitles the person whose data is on the Ticket to a one-time entry to the Event Area combined with the exchange of the Ticket for an Identifier. The Organizer warns that if the Ticket is made available in any form to a third party, this Ticket may be used by that or another person to enter the Event Area, which will consequently result in the original Ticket purchaser not being able to use it. The Ticket purchaser should therefore ensure the confidentiality of the Ticket and not make it available to third parties. The Organizer warns that buying Tickets from unauthorized persons, outside the official sales channels listed above, carries the risk of purchasing a counterfeit ticket, which will consequently result in the refusal to exchange such a ticket for an Identifier, and thus the refusal of entry to the Event. The Organizer informs that, in accordance with Article 133 § 1 of the Code of Misdemeanors, it is forbidden to acquire entry tickets to artistic, entertainment, or sports events for resale at a profit, and to sell such tickets at a profit. Attempting, aiding, and abetting are also punishable in accordance with Article 133 § 2 of the Code of Misdemeanors. Any public offering of the transfer of ownership of Tickets is prohibited, including as prizes in contests, lotteries, in promotional sales, or any other promotions, even if it is free of charge, unless the Organizer gives consent, in accordance with the provision of point 7. Returns of Tickets combined with a refund of the paid price are only possible in cases explicitly specified in these Regulations or in the Ticket sales regulations, in the event of cancellation of the Event, change of location or date of the Event, or in the case of restrictions imposed on the Organizer by public administration bodies. In such a case, the Organizer will always announce information about the possibility and conditions of Ticket returns. Failure to use the Ticket does not entitle one to demand a refund of the price.
7. Sponsors, media patrons, as well as selected media representatives (radio, television, press), after obtaining the Organizer's consent, are authorized to organize contests in which the prize will be personalized entry Tickets to the Event. A ticket won in a contest may only be used by the winner, may not be transferred to a third party, and is subject to exchange for an Identifier upon presentation of the Ticket and proof of identity. Prize tickets are not exchangeable for cash or material equivalent. The rules and course of the contests are specified in separate regulations of the entities organizing them.
8. Only an original Ticket, purchased in accordance with the provisions of these Regulations and the regulations of sales points and authorized distributors, may be exchanged for an Identifier. A Ticket purchased in violation of the provisions of these Regulations may be invalidated by the Organizer (or its representative), without the right to a refund of the price, and thus will not entitle to entry to the Event.
9. In the event that a disabled person (holding a valid disability certificate) wishes to participate in the Event, they are obliged to purchase a Ticket on general terms. In the event that a disabled person (holding a valid disability certificate), due to the type of physical disability, moves in a wheelchair, uses crutches, a walker, or has visual or hearing impairment, as well as due to the type of intellectual disability, requires constant care, their caregiver is entitled to purchase a Ticket with a 50% price reduction.
A disabled person participating in the Event with a caregiver is obliged to possess a valid disability certificate during the Event. The Organizer reserves the right to verify the possession of the certificate mentioned in the preceding sentence, especially upon the entry to the Event of a disabled person with their caregiver who has taken advantage of the reduced price Ticket.
IV. ENTRY TO THE EVENT
10. Subject to the provisions of Chapter VIII of the Regulations, the right to enter the Event Area belongs to a person carrying an identity document and a valid Ticket, which will be exchanged for an Identifier upon the first entry to the Event Area.
Each subsequent re-entry to the Event Area is only granted to the Participant with an Identifier permanently attached to their wrist. If the Participant is a minor under 16 years of age, they may participate in the Event only under the care of an adult, who, upon first entry to the Event, at the information point, will present a declaration of responsibility for the minor person according to the form developed by the Organizer. Minor persons aged 16-18, to be able to participate in the Event without adult supervision, are obliged to provide to the information point a declaration expressing consent for their participation in the Event, signed by their legal guardian.
11. Regardless of meeting the conditions referred to in point 10 above, entry to the Event Area is denied to a person:
against whom a ruling has been issued: a) prohibiting entry to a mass event, b) obliging to refrain from being present in places where mass events are held, issued by a court against a convicted person in connection with the conditional suspension of the execution of a custodial sentence or against a minor on the basis of Article 6 point 2 of the Act of October 26, 1982, on proceedings in matters of minors; against whom a club ban or international ban has been applied in accordance with the Act on the safety of mass events; for whom there is a reasonable suspicion that they may pose a threat to the safety of the mass event at the place and time of the event; who is visibly under the influence of alcohol, intoxicants, psychotropic substances, or other similar acting agents; who refuses to comply with crowd control measures specified in Chapter V of the Regulations; possessing weapons or other dangerous items, explosives, pyrotechnic articles, fire-hazardous materials, alcoholic beverages, intoxicants, or psychotropic substances; The assessment of items and their qualification as dangerous belongs to the security and information services; behaving aggressively, provocatively, or in any other way posing a threat to safety or public order.
12. Regardless of the circumstances referred to in point 11, the Organizer may refuse entry to the Event and presence in the Event Area to persons (remove from the Event area):
who do not have an Identifier; wearing shoes with metal tips; whose external appearance prevents identification; possessing plastic or glass containers, cans, bottles, etc. – this does not apply to Participants entering the Event Area with a child, if the containers they carry are used and necessary to provide the child with a drink or meal; who do not have an identity document; behaving inappropriately (suggesting being under the influence of alcohol, psychotropic or intoxicating substances, aggressive individuals, behaving in a manner that disturbs the comfort or safety of other Participants, or behaving contrary to the provisions of these Regulations or the regulations of the facilities).
13. Entry to individual Zones designated in the Event Area is granted to persons holding the appropriate Identifier. The Organizer designates Event division zones for: concert stages, technical and social facilities, audience, catering zone, children's zone, main entrance teams, sanitary points, permanent security points for security services, camping.
V. ORGANIZATIONAL AND ORDER RULES APPLICABLE IN THE EVENT AREA
14. The Organizer ensures the safety of persons present at the Event and order during the Event, by fulfilling the obligations referred to in Article 6 of the Act on the safety of mass events, in particular:
participation of Security Services and Information Services distinguished by elements of clothing; appointment of a safety manager, who directs the Security Services and organizes their work; provision of medical assistance and sanitary facilities; provision of medical assistance; designation of evacuation routes and routes enabling access for emergency services and Police vehicles.
15. Participants of the Event and all other persons present in the Event Area are obliged to follow the instructions of the Security Services, including the safety manager.
16. Participants of the Event and all other persons present in the Event Area are obliged to behave in a manner that does not endanger the safety of other persons present at the Event, and in particular to comply with the provisions of these Regulations and the regulations of the facilities.
It is forbidden to destroy signs and information boards, advertising carriers, devices and equipment located in the Event Area, etc. Participants are obliged to use sanitary facilities only for their intended purpose.
17. Participants and all persons in the Event Area are obliged to wear a valid Identifier on their wrist throughout the duration of the Event. The absence of an Identifier or having a torn or damaged Identifier, as well as an Identifier not fastened to the wrist, is a clear basis for removing the Participant from the Event Area. In the event of a torn or damaged Identifier, the Event Participant is obliged to immediately report to the Information Services at the Event gate (entrance), where the damaged Identifier will be replaced with a new one and fastened to the wrist. Only an Identifier damaged within the Event Area can be replaced.
18. It is forbidden to bring in and possess professional photographic cameras, video cameras, and other audio or audio-video recording equipment during the Event. Amateur digital cameras and traditional amateur compact cameras may be brought into the Event Area. It is not allowed to bring in photographic equipment that may have professional use, e.g., small-format SLRs, digital SLRs, medium- and large-format cameras, etc.
19. It is forbidden to bring dogs and other animals into the Event Area, with the proviso that this does not apply to blind or disabled persons who require the assistance of a guide dog.
20. It is forbidden to conduct any commercial or for-profit activity in the Event Area without the Organizer's consent.
21. The Organizer, within the scope specified by the Act on the safety of mass events and executive regulations, is authorized to record the course of the Event, and in particular the behavior of persons, using devices recording images and sound. Materials collected during the recording of the Event, which may constitute evidence allowing for the initiation of criminal proceedings or proceedings in misdemeanor cases or evidence relevant to ongoing such proceedings, the Organizer immediately transfers to the district prosecutor competent for the Event Area or the Police. Materials collected during the recording of the Event, not containing evidence allowing for the initiation of criminal proceedings or proceedings in misdemeanor cases or evidence relevant to ongoing such proceedings, are stored after the Event for a period of at least 30 days, but no longer than 90 days, and then are subject to commission destruction.
22. The Security Services, holding an identifier placed in a visible place, are authorized in accordance with the provisions of the Act on the safety of mass events to:
check the right to be present at the Event, identify persons to establish their identity, inspect the contents of luggage, clothing of persons, in case of suspicion that these persons are bringing in or possessing items referred to in Chapter IV and V of the Regulations, ascertain the right of persons to be present at the Event, and in the absence of such rights – call upon them to leave the Event, issue orderly instructions to persons disturbing public order or behaving contrary to the Regulations, and in the event of non-compliance with these instructions – call upon them to leave the Event, use direct coercive measures such as physical force in the form of transport techniques and defense techniques, handcuffs placed on wrists, chemical incapacitating agents in the form of hand-held incapacitating substance dispensers – in cases where it is necessary to enforce legally required behavior in accordance with an issued instruction or to repel a direct, unlawful assault on the life, health or freedom of a member of the Security Services or another person (the use of direct coercive measures and documentation of such use takes place on the principles specified in the Act of May 24, 2013, on direct coercive measures and firearms), apprehension, for the purpose of immediate transfer to the Police, of persons posing a direct threat to human life or health, as well as protected property. The activities listed above are performed in a manner that ensures respect for human dignity and other personal rights of the person against whom they were undertaken.
23. The Security Services are obliged to remove from the Event Area persons whose behavior disturbs public order or who behave contrary to the Regulations or the regulations of the facilities.
24. Members of the Security Services, depending on potential risk and needs, may be equipped with, among other things:
handheld metal detectors, sample tickets, identifiers, and invitations, other necessary and legally permissible personal protective equipment.
25. A member of the Security Services confirms a person's right to be at the Event by:
checking that the person has a valid Ticket, and after exchanging it, that they have an undamaged Identifier fastened to their wrist, and comparing the presented document with the template.
26. In the event that items whose bringing and possession at the Event are prohibited are found in the contents of searched luggage or clothing, a member of the Security Services shall refuse entry to the Event Area to the person found to possess such items or shall order them to leave the Event Area.
27. In the event that weapons or other dangerous items, explosive, pyrotechnic and fire-hazardous materials, and illicit narcotic and psychotropic substances are found in the contents of searched luggage or clothing, a member of the Security Services shall apprehend the person found to possess these items in their searched luggage or clothing, and after confiscating them, shall draw up a report of this action, and then hand over this person to the Police along with the confiscated items.
28. Persons who have been refused entry to or presence at the Event, or who have been removed from the Event Area in accordance with the provisions of the Regulations due to its violation (or violation of venue regulations) or due to violation of generally applicable legal provisions, are not entitled to a refund of the Ticket price.
29. The Organizer undertakes to ensure fire safety, among others, by:
providing information on the location of fire extinguishing equipment and procedures in case of fire by service staff, Organizers and Security Services, guaranteeing training of Security Services in the scope of: evacuation procedures, how to alert the fire brigade, rules for using portable fire extinguishing equipment and providing first medical aid.
30. During the Event, the Organizer and Participants, as well as other persons present in its Area, are obliged to comply with generally applicable legal provisions, including in particular the provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism.
31. The form of payment accepted within the Event Area, particularly in the gastronomic zone, shall be vouchers and/or payment by card. Cash can be exchanged for vouchers at designated points within the Event Area.
VI. RIGHTS AND OBLIGATIONS OF EVENT PARTICIPANTS
32. The Organizer reserves the right to establish and change the Event program for justified reasons, and also the right to change the program in terms of artistic content and timing without prior consultation, compensation or indemnification for Participants. Changes to the Event program do not entitle Participants to return Tickets or demand a refund of their price.
33. Due to the large number of Participants, the need to exchange Tickets for Identifiers, and the necessary control and security measures applied at the entrance to the Event, Participants are requested to arrive at the Event venue with sufficient advance notice.
34. The Organizer informs that in the case of concerts and events held in enclosed halls with a limited number of seats, possessing a valid Ticket/Identifier does not guarantee entry to such a concert or event. Due to the safety of participants, entry to each hall will be limited, and entry will be on a first-come, first-served basis. It is not possible to reserve seats in advance.
35. The Organizer informs that the Participant or other person staying in the Event Area will constantly be exposed to loud sounds, which may, in particular, cause hearing damage. Stroboscopic lights will also be used during the Event.
36. The Organizer reserves that it records the course of the Event for documentation and promotion or advertising purposes of the Event and its subsequent editions in future years, the Organizer, and sponsors. The image of persons present at the Event Area may be recorded and subsequently disseminated for documentary, reporting, advertising, and promotional purposes. In connection with the above, the Organizer may process Participants' personal data – in the form of their image – based on Article 6(1)(f) of the GDPR, in connection with the realization of the legitimate interest of the Organizer described above. This data will be stored until the User effectively objects – based on the provisions of the GDPR.
37. Within the Event Area, there will be a Kids Zone available for children aged 4 to 12 years.
VII. COMPLAINTS
38. All complaints may be submitted in writing to the following correspondence address of the Organizer:

VIII. PRIVACY POLICY

Contact with the administrator: biuro@fnmk.pl Participants' personal data will be processed for the purpose of executing the contract to which the Participant is a party in connection with participation in the Festival in the scope of ticketed events - based on Article 6(1)(b) of the GDPR, and in the case of Participants who obtained tickets to the Festival as prizes in competitions organized by the Administrator or third parties, Participants' personal data will be processed for the purpose of verifying the right to receive the prize - based on Article 6(1)(f) of the GDPR, in connection with the realization of the legitimate interest of the Administrator described above. In the case of persons who receive accreditation, data will be processed based on Article 6(1)(b) of the GDPR in connection with participation in the Festival in the scope of the received accreditation. In connection with the existing epidemic situation, the Administrator reserves the right to process Participants' personal data, such as first name and last name, phone number, and email address, based on Article 6(1)(d) of the GDPR, striving to protect the vital interests of the Participant and other Participants, i.e., to enable epidemiological investigation and to inform the participant about the epidemic threat. This data may also be transferred to the relevant sanitary and epidemiological services to fulfill their statutory obligations related to combating the epidemic. The recipients of the collected personal data will only be entities authorized to receive this data based on applicable legal provisions. In particular, based on Article 8a of the Act of March 14, 1985, on the State Sanitary Inspection, the participant's personal data may be made available to the Chief Sanitary Inspector and law enforcement agencies. Personal data will be stored for a period of 14 days from their collection. After this time, the data may be stored in connection with the realization of the Administrator's legitimate interest, for the purpose of handling claims related to the organization of the Festival and the execution of contracts to which the Participant is a party in connection with participation in the Festival - based on Article 6(1)(f) of the GDPR - until these claims expire or become time-barred. Participants have the right to access their data, rectify it, erase it or restrict its processing, as well as the right to object and demand cessation of processing and data portability, on the terms specified by law. Participants have the right to lodge a complaint with the supervisory authority of the President of the Personal Data Protection Office if they suspect that their personal data is being processed in violation of generally applicable legal provisions. Providing personal data is voluntary. Failure to provide data will result in the inability to participate in events organized by the administrator. Participants' personal data will not be transferred to a third country or international organization. Participants' personal data will not be the basis for automated decision-making or profiling, as referred to in Article 22 of the GDPR.
IX. FINAL PROVISIONS
40. All rights to the name and logo of the Event are reserved for the Organizer. Official programs and gadgets related to the Event will be sold exclusively within the Event Area or at sales points authorized by the Organizer.
41. The status of Event sponsor is granted solely by the Organizer.
42. These Regulations are available:
a) on the Event website – www.festiwalnowamuzyka.pl, b) at Ticket sales points, c) at information points within the Event Area, d) at ticket offices.
43. Correspondence to the Organizer should be sent to the address indicated in point 2, in writing, by registered mail.
44. Security Services may issue their own safety and fire prevention instructions in accordance with applicable regulations, which are binding on Event participants. In matters not regulated by these Regulations, generally applicable legal provisions shall apply.
The Organizer reserves the right to amend the provisions of the Regulations, about which it will inform on the website dedicated to the Event. The Regulations come into force on May 1, 2026.
